PORTRAIT SESSION CONTRACT
Booking & Payment:
The retainer fee, the full session fee, is due in full to the photographer upon booking your session date in order to lock in your session. All monies paid are non-refundable. Accepted Forms of payments for session service is Cash, Venmo, or PayPal. Paypal payments made to: firstname.lastname@example.org or use the following link: paypal.me/usmanbaporia. Venmo ID is @Usman-Baporia
Copyrights & Reproductions:
All images, designs, and digital files are the exclusive property of Usman Baporia Photography and can be used for advertisement purposes, internet display, blog postings, and Facebook postings.
If the Client is purchasing the files they are obtaining the files in agreement to use for personal use only and shall not sell or authorize any reproduction by parties other than Usman Baporia Photography. While we do not like to use watermarks on the images that we provide the client, would greatly appreciate that all social media postings be accompanied with credit to Usman Baporia Photography.
Cancellation & Postponement:
If the Client needs to change/cancel, for any reason, the date or time of the session, any paid retainer fees will not be refunded. It is understood that the Client must give at least 24 hours notice and is responsible to reschedule the session date and time.
If the Client is not at the session location within 30 minutes of the agreed upon session start time, the Photographer has the right to cancel or postpone the session and the Client is responsible to reschedule the new session date if applicable. After 30 minutes, the Client will be considered a “no show” and no monies paid or retainer fees will be refunded to the Client. Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for the session.
Failure to Perform:
If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return the retainer to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
